Permissions
NRIs can purchase residential or commercial land in India without restrictions or special permission from the Reserve Bank of India (RBI), as RBI has granted general permission to all NRIs. However, NRIs cannot buy farmhouses, agricultural land, or plantation land without prior RBI approval. For these specific property types, NRIs must obtain approval before purchasing.
Ownership
Non-Resident Indians (NRIs) can buy residential or commercial property in India under FEMA and RBI guidelines and can finance the property with a home loan in Indian rupees. They can own property solely or jointly with an Indian citizen, given eligibility criteria are met. However, NRIs are restricted from purchasing agricultural land, plantation property, or farmhouses.
Power of attorney
The Power of Attorney (POA) is crucial for NRIs buying property in India per the Registration Act. This act requires the local registrar to validate the buyer’s and seller’s signatures. Suppose an NRI cannot be present in person. In that case, their POA, typically a family member, must be certified by the Consulate in the NRI’s country of residence to validate the transaction.
Payment
As an NRI, you can only buy property in India using Indian currency. Payments cannot be made in the currency of your current residence. You can use non-resident accounts like NRO/NRE (Non-Resident Ordinary/External Account) or FCNR (Foreign Currency Non-Resident Account) for this purpose, following the Foreign Exchange Management Act (FEMA) and RBI regulations.
Loan
NRIs can obtain home loans to purchase real estate in India without restrictions on loan amounts. Most banks and NBFCs offer loans to NRIs, although interest rates may be higher and vary by lender. Taking a home loan is feasible for buying property in metro cities like NCR, where real estate prices are higher.
Taxes and charges
Any income from property in India is taxed. Rental income incurs 30% TDS, while property resale incurs 20% TDS for long-term capital gains, with short-term capital gains taxed per NRI income tax slab rates. Additionally, NRIs face stamp duty charges, registration fees, and GST as applicable.
